The International Court of Justice (ICJ) holds public hearings in the advisory proceedings on the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem.

Description

The International Court of Justice (ICJ), the principal judicial organ of the United Nations, holds public hearings on the request for an advisory opinion on the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem, from 19 to 26 February 2024, at the Peace Palace in The Hague, the seat of the Court. Session held under the presidency of Judge Nawaf Salam, President of the Court.

  • Kicking off proceedings, the representative of South Africa compared the Israeli occupation to apartheid and said the ICJ’s hearings could help bring an end to a system of racial oppression that had no place in the modern world.
  • Overall, the speakers’ main points revolved around the right of Palestinian people to self-determination and the permanent nature of Israel’s occupation, which is resulting in a de facto annexation.

28 Feb: Ralph Wilde, representative of the Arab League, and a powerful legal speech at the ICJ. Although the speech is considered one of the most powerful, it surprised Arab countries and none of them mentioned it in their media.
23 Feb 2024: Speaking at the International Court of Justice UK representative Dan Sarooshi has asked the court not issue an advisory opinion on Israel’s occupation of Palestine, because Israel has not given consent. UK also argued that Israel’s withdrawal from the occupied territories should be through negotiations and not a court decision.
24 Feb 2024: Norway: “Israel’s actions in the OCCUPIED territories are a violation of international law” “The apartheid wall is a violation of international law and makes the two-state solution difficult to achieve. Gaza Strip and the West Bank are occupied territories regardless of any Israeli withdrawal. The occupation remains temporary and cannot be continued or justified. Israel violates international law and continues to violate it. Israel must abide by international law and provide the right to self-determination to the Palestinians. Israel’s actions in the occupied territories are a violation of international law. It is not legal to annex any Palestinian lands or impose a fait accompli on the ground. Establishing settlements in Palestinian territories violates Article 416 of the Geneva Convention. Israel exploits natural resources to perpetuate its occupation of Palestinian territories. Measures must be taken to prevent Israeli practices that violate international.”
