Uganda’s dissenting ruling explained

Following the ICJ ruling, the one dissenting voice on all counts, Justice Julia Sebutinde from UGANDA, has caused outrage across Africa and pro-Palestinian people, and even in her own country, Uganda. She stated that the issue was ‘political and diplomatic’ but not legal, which is why she made this ruling saying that main argument in her dissenting opinion that she is not convinced with provisional measures because she believes the dispute is political and diplomatic one that cannot be settled in court, then she delved into pure legal reasoning for her opinion. She even out-bid Israel’s own chosen judge Aharon Barak.

“I am not convinced that a prima facie showing of a genocidal intent, by way of indicators, has been made out against Israel. The war was not started by Israel but rather by Hamas who attacked Israel on 7 October….”

Ambassador and Permanent Representative of Uganda to the United Nations, Adonia Ayebare, however, stated on Twitter: “Justice Sebutinde ruling at the International Court of Justice does not represent the Government of Uganda’s position on the situation in Palestine. She has previously voted against Uganda’s case on DRC. Uganda’s support for the plight of the Palestinian people has been expressed through Uganda ‘s voting pattern at the United Nations.”
